1. Introduction

MoldGuide.com is operated by MiniGig, a Texas business doing business as MoldGuide ("MoldGuide," "we," "us," or "our"). This Privacy Policy describes how we collect, use, disclose, and protect information about you when you visit our website, use our tools, submit a lead inquiry as a homeowner, or register as a contractor.

By using the Site, you consent to the practices described in this Policy. This Policy is incorporated into and subject to our Terms of Service. If you do not agree to this Policy, do not use the Site.

2. Information We Collect

2.1 Information You Provide Directly

Homeowners (lead inquiries): When you submit our mold assessment quiz or any lead capture form, we collect:

Contractors: When you register an account, we collect:

Contact forms: Name, email, and message content submitted through our contact page.

2.2 Information Collected Automatically

When you visit the Site, we and our service providers automatically collect:

2.3 Information from Third Parties

We may receive information from third-party analytics providers (such as Google Analytics 4) about how users interact with our Site.

3. How We Use Your Information

We use the information we collect for the following purposes:

4. How We Share Your Information

4.1 With Contractors (Core Service)

This is the central data sharing practice of our business, and by using the lead referral service, you expressly consent to it: When you submit a lead inquiry, your name, phone number, email address, service address/ZIP, and problem description are shared with one or more mold remediation contractors matched to your geographic area. Contractors receive this information to contact you about your mold situation. Once a lead is delivered to a contractor, MoldGuide cannot control how that contractor handles your information, though contractors are required by our Terms to handle lead data in compliance with applicable privacy laws.

4.2 With Service Providers

We share information with third-party vendors and service providers that perform services on our behalf:

These providers access information only to perform services on our behalf and are required to maintain appropriate confidentiality and security measures.

4.3 Legal Requirements

We may disclose your information if required to do so by law or in response to a valid legal process (such as a court order, subpoena, or government request), or when we believe disclosure is necessary to protect the rights, property, or safety of MoldGuide, our users, or the public.

4.4 Business Transfers

If MoldGuide is involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of all or a portion of its assets, your information may be transferred as part of that transaction. We will provide notice of any such transfer that involves a material change to this Privacy Policy.

4.5 What We Do Not Do

We do not sell your personal information to data brokers, advertising networks, or any third party for monetary consideration. Lead information is shared only with contractors for the specific purpose of responding to your inquiry. We do not use homeowner lead data for advertising targeting.

5. Cookies and Tracking Technologies

We use the following technologies to collect information automatically:

We do not use advertising cookies, retargeting pixels, or social media tracking pixels. You can control cookies through your browser settings; however, disabling certain cookies may affect Site functionality.

6. Data Security

We implement commercially reasonable technical and organizational measures to protect your information against unauthorized access, disclosure, alteration, or destruction. These measures include encryption of data in transit (HTTPS/TLS), access controls, and use of reputable cloud infrastructure providers.

No method of transmission over the Internet or electronic storage is 100% secure. We cannot guarantee absolute security of your information. You are responsible for maintaining the security of any account credentials and for any activity that occurs under your account. Please notify us immediately of any suspected unauthorized access to your account.

7. Data Retention

After the applicable retention period, data is deleted or anonymized. Note that data may persist in encrypted backup systems for a limited period after deletion from active systems. Anonymized or aggregated data that cannot be used to identify you may be retained indefinitely.

8. Your Rights and Choices

You have the following rights with respect to your personal information:

To exercise any of these rights, email [email protected] or use our contact form. We will respond within 45 days. Note that deletion of homeowner lead data that has already been shared with contractors cannot be recalled from those contractors — we can only delete data from our own systems.

9. Children's Privacy

The Site is not directed to children under the age of 13, and we do not knowingly collect personal information from children under 13. If we become aware that we have collected personal information from a child under 13 without verifiable parental consent, we will take steps to delete that information promptly. If you believe a child under 13 has provided personal information to us, please contact us at [email protected].

10. Third-Party Links and Services

The Site may contain links to third-party websites, including contractor websites, government resources, and other external sites. MoldGuide is not responsible for the privacy practices or content of these third-party sites. We encourage you to review the privacy policies of any third-party site you visit. This Policy applies only to information collected by MoldGuide through this Site.

11. California Privacy Rights (CCPA/CPRA)

If you are a California resident, you have the following additional rights under the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA):

Categories of personal information collected in the preceding 12 months: Identifiers (name, email, phone, IP address, ZIP code); commercial information (contractor payment and transaction records); internet or other electronic network activity (usage data, pages visited); geolocation data (approximate location from IP); and inferences drawn from the above to understand service needs.

To exercise your California rights, contact us at [email protected] with the subject line "California Privacy Request." We will verify your identity before processing your request. You may also designate an authorized agent to submit requests on your behalf; we will require written authorization and identity verification. We will respond within 45 days, with a possible 45-day extension with notice.

12. Other U.S. State Privacy Laws

Residents of certain states (including Virginia, Colorado, Connecticut, and others with comprehensive privacy laws) may have rights similar to those described in Section 11, including rights to access, correct, delete, and opt out of certain processing. To exercise any such rights, contact us at [email protected]. We will respond as required by applicable law.

13. Changes to This Policy

We may update this Privacy Policy from time to time. When we make changes, we will update the "Last updated" date at the top of this page. For material changes, we will provide additional notice as feasible (such as by posting a notice on the Site or sending an email to registered users).
